Q: What are my voting rights in the Condominium Association?

A: The Owner or Owners of a unit shall collectively be entitled to cast one (1) vote per unit owned.

Q: What restrictions exist in the Condominium Documents on my right to use my Unit?

A: Restrictions are contained Section 12 of the Declaration of Condominium and in the Rules and Regulations. Unit use is limited to residential purposes. The keeping of pets and their presence at the Condominium is controlled. Certain vehicles are prohibited from parking at the Condominium. See Declaration of Condominium and Rules and Regulations for a complete copy of restrictions.

Q: What restrictions exist in the Condominium Documents on my right to lease my Unit?

A: All leases must be approved by the Condominium Association. The minimum lease term is thirty (30) days and no more than five (5) leases per year are allowed. For a complete discussion of lease restrictions, see Section 13 of the Declaration of Condominium.

Q: How much are my assessments to the Condominium Association for my Unit type and when are they due?

A: Regular assessments are in the amount of $802.91 per quarter. This amount includes the annual assessments for Rosewood Pointe Gardens Commons Association, Inc. listed below but does not include assessments to Bonita Fairways Community Association, Inc. listed below. The Association will bill regular assessments quarterly.

Q: Do I have to be a member in any other association? If so, what is the name of the association and what are my voting rights in this association? Also, how much are my assessments?

A: Yes. You are automatically a member of Bonita Fairways Community Association, Inc. with voting rights of one (1) vote per unit which are cast in a block by the condominium association. There is currently an annual assessment of $387.00. The condominium association is automatically a member of Rosewood Pointe Gardens Commons Association, Inc. Voting rights are exercised by the condominium association with one (1) vote for each unit in the condominium association. There is currently a quarterly assessment of $125.67 which is included in the condominium association's assessment.

Q: Am I required to pay rent or land use fees for recreational or other commonly used facilities? If so, how much am I obligated to pay annually.

A: No.

Q: Is the condominium association or other mandatory membership association involved in any court cases in which it may face liability in excess of $100,000.00? If so, identify each such case.

A: No.
